2026 Cannabis Banking in Vermont: Laws, Licensing and Market Status
Vermont’s regulated cannabis market is small but well established, with hundreds of licensed businesses ranging from craft cultivators to retail stores in towns that voted to allow them. A 2026 law raised possession limits and created cannabis event permits. Combined with federal rescheduling and the new federal hemp rules, it adds to the list of changes Vermont cannabis businesses need their bank to handle.
Vermont’s Cannabis Law and the Cannabis Control Board
Vermont has allowed medical cannabis since 2004. It legalized adult possession and home cultivation in 2018 and created its regulated retail market through Act 164 of 2020, and adult-use retail sales began in October 2022. The Vermont Cannabis Control Board (CCB) licenses and regulates cultivators, manufacturers, wholesalers, retailers, testing labs and integrated licensees, and it also oversees the medical program. Retail stores can open only in municipalities whose voters have opted in.
Act 176 of 2026: Higher Limits and Cannabis Events
Governor Phil Scott signed S.278 on June 18, 2026, as Act 176 of 2026. The law doubles the adult purchase and public possession limit to two ounces and creates a permit for cannabis events, NORML reported. For retailers, a larger allowable purchase can mean larger cash transactions and higher daily deposits.
Vermont’s Cannabis Market and Taxes in 2026
- Licenses: roughly 560 active licenses in early 2026, including about 110 retailers, according to the CCB chair’s April 2026 update to lawmakers.
- Taxes: retail sales carry Vermont’s 14% cannabis excise tax plus the 6% sales tax. The state collected about $20.2 million in cannabis excise tax and $8.4 million in sales tax on cannabis in fiscal 2025.
- Market size: legislative fiscal staff estimate the adult-use market at about $161 million in fiscal 2026 (Joint Fiscal Office presentation).
Vermont Hemp and CBD Businesses
Vermont hemp growers are licensed directly by the U.S. Department of Agriculture rather than through a state plan, according to the USDA hemp program. The federal hemp redefinition enacted in November 2025 counts total THC and excludes synthesized cannabinoids. The synthetic exclusion starts November 12, 2026, and most other provisions take effect December 11, 2026, which will narrow the range of intoxicating hemp products that Vermont stores can stock outside the CCB system. Herring Bank offers hemp banking and CBD banking for compliant operators.
Federal Changes That Affect Vermont Cannabis Businesses
Effective April 28, 2026, the U.S. Department of Justice and DEA moved FDA-approved marijuana products and marijuana subject to a qualifying state medical license from Schedule I to Schedule III. In Vermont, that applies to medical cannabis dispensaries licensed under the state medical program, which gain a DEA registration pathway and are expected to be free of Section 280E going forward. Vermont’s adult-use retailers, cultivators and manufacturers remain under Schedule I and 280E while the DEA’s broader rescheduling proceeding continues.
Federal banking law has not changed. The SAFE Banking Act of 2026 (S. 4942), with a House companion, H.R. 9471, was introduced in June 2026 and remains in committee. Until Congress acts, cannabis businesses need a bank that follows FinCEN guidance for marijuana-related businesses, including enhanced due diligence, ongoing monitoring and Suspicious Activity Report (SAR) filing.
