2026 Cannabis Banking in Southaven: Laws, Licensing and Market Status
Southaven is Mississippi’s third-largest city and the commercial heart of DeSoto County, just south of Memphis. It is also one of the state’s most closely watched cannabis markets because the city has not yet joined the Mississippi Medical Cannabis Program. Dispensaries in neighboring Olive Branch, Horn Lake and Hernando serve DeSoto County’s patients, and many of the people who own, manage and work in those businesses live in Southaven. For them, and for Southaven’s hemp and CBD retailers, Southaven cannabis banking means compliant accounts, secure cash handling and a bank that understands Mississippi’s program.
Southaven’s Local Rules for Medical Cannabis
When the Mississippi Medical Cannabis Act passed in 2022, cities had until May 3, 2022 to opt out, and Southaven did, citing the need for zoning first. The city later created a Commercial Medical zoning overlay where dispensaries could locate if it opts in. In November 2025 the Board of Aldermen directed the city attorney to draft an ordinance allowing dispensaries only in that district, and in December 2025 the board reviewed the draft without taking a vote, with the mayor and several aldermen opposed. As of this writing the city has not completed an opt-in, so licensed dispensaries, cultivators and processors cannot yet operate inside Southaven. Check with the city before committing to a location.
Mississippi’s Medical Cannabis Program in 2026
Mississippi legalized medical cannabis in 2022. Recreational marijuana remains illegal. Two agencies run the Mississippi Medical Cannabis Program: the Mississippi State Department of Health licenses patients, practitioners, cultivators, processors, transporters, waste disposal and testing labs, while the Department of Revenue licenses dispensaries and collects cannabis taxes. The program keeps growing:
- Retail sales: about $138.9 million in calendar 2025, and $158.8 million in the state’s fiscal year 2026 (July 2025 through June 2026), according to Department of Revenue data.
- Patients: 66,041 active patients at the end of 2025, rising past 68,000 by spring 2026.
- Licensees: roughly 170 to 175 dispensaries statewide, plus cultivators, micro-cultivators, processors, transporters and testing labs, with about nine dispensaries operating in DeSoto County.
- Taxes: a 5% excise tax on the first sale from cultivator to dispensary and the 7% state sales tax at retail.
Expansion stalled in Jackson in 2026. Gov. Tate Reeves vetoed HB 1152, a “right to try” bill for patients with serious conditions not on the qualifying list, and HB 895, which would have relaxed follow-up visit, caregiver card and potency rules, saying both moved the program closer to recreational use.
State Banking Protections and Federal Rules
The Mississippi Medical Cannabis Act expressly lets banks serve licensed medical cannabis businesses and shields them from state liability for doing so, but federal law still sets the compliance bar. Effective April 28, 2026, marijuana subject to a qualifying state medical license moved to Schedule III, along with FDA-approved marijuana products. Because every Mississippi licensee operates under the state medical program, the order covers them. Adult-use marijuana remains in Schedule I.
The SAFE Banking Act of 2026 (S. 4942) is still in committee, so banks continue to follow FinCEN’s guidance for marijuana-related businesses, including enhanced due diligence and Suspicious Activity Report filing. Southaven hemp and CBD retailers should also plan for the federal hemp redefinition, most of which takes effect December 11, 2026 and removes many intoxicating hemp-derived THC products from the legal market.
