2026 Cannabis Banking in Miami: Laws, Licensing and Market Status
Miami-Dade County has dozens of approved medical marijuana dispensing locations today, but the City of Miami took a long road to get there. The operators behind those dispensaries, along with their suppliers, landlords, security firms and other vendors, need banking built for a cash-intensive, closely regulated industry. Here is where Miami cannabis banking stands in 2026.
Miami’s Local Dispensary Market
For years the City of Miami refused to issue certificates of use for medical marijuana dispensaries, citing marijuana’s federal Schedule I status. As of April 2022, not a single dispensary had opened within city limits, even though 27 were operating elsewhere in Miami-Dade County, and the dispute over the first proposed location in Park West went to the City Commission. Under Florida law, a city or county may ban dispensing facilities outright, but one that allows them must regulate them no more strictly than pharmacies and may not cap their number.
The market has grown well beyond those early disputes. The Office of Medical Marijuana Use (OMMU) dispensing location list shows 41 approved locations in Miami-Dade County as of mid-October 2026, including 20 with Miami addresses and 6 in Miami Beach.
Florida’s Medical Marijuana Rules in 2026
Florida is a medical-only state. Recreational marijuana fell short at the ballot box in 2024: Amendment 3 drew about 56% of the vote, below the 60% supermajority Florida requires for constitutional amendments. Smart & Safe Florida’s follow-up initiative then failed to qualify for the November 2026 ballot after state officials found it short of the roughly 880,000 valid signatures required; the Florida Supreme Court dismissed the campaign’s case in February 2026 and declined to revisit its signature challenge in March.
The medical program itself is large and growing. According to OMMU’s October 9, 2026 update:
- 942,370 qualified patients hold active medical marijuana ID cards.
- 782 approved dispensing locations operate statewide.
- Only licensed Medical Marijuana Treatment Centers (MMTCs) may cultivate, process and dispense, and each MMTC must earn cultivation, processing and dispensing authorizations in turn. Every order is recorded in the Medical Marijuana Use Registry.
Hemp, CBD and THC Products in Miami
Miami’s hemp and CBD shops follow a separate set of rules. Under SB 1676, signed in June 2023, Florida prohibits the sale of hemp products to anyone under 21, and the Department of Business and Professional Regulation has made hundreds of arrests in underage-sales stings, referring cases to the Florida Department of Agriculture and Consumer Services. The federal hemp redefinition enacted in November 2025 moves to a total-THC standard and excludes synthesized cannabinoids, with most provisions taking effect December 11, 2026. Herring Bank offers hemp banking and CBD banking for compliant Florida sellers.
Federal Changes for Miami Cannabis Businesses
Effective April 28, 2026, marijuana subject to a qualifying state medical license moved from Schedule I to Schedule III, along with FDA-approved marijuana products. Florida MMTCs operate under state medical licenses, so they fall within the order, which provides a DEA registration pathway and is expected to take licensed medical activity out of Section 280E going forward. Banking law has not caught up: the SAFE Banking Act of 2026 (S. 4942) remains in committee, and banks serving the industry still follow FinCEN’s guidance for marijuana-related businesses.
