2026 Cannabis Banking in Arkansas: Laws, Licensing and Market Status
Arkansas runs a mature medical marijuana market, and it is still a medical-only state in 2026. Ten years after voters approved the Arkansas Medical Marijuana Amendment in November 2016, the market moves close to $300 million a year through a small, tightly licensed group of dispensaries and cultivators. For those businesses, Arkansas cannabis banking means compliant accounts for daily cash deposits, payroll, state tax payments and vendor payments, all handled under federal marijuana-related business (MRB) rules.
Arkansas Medical Marijuana Law and Regulators
The program rests on Amendment 98 to the Arkansas Constitution, which voters approved 53% to 47% in 2016 and which covers 17 qualifying conditions. Two state agencies split oversight:
- Arkansas Medical Marijuana Commission (AMMC), part of the Department of Finance and Administration (DFA), licenses dispensaries and cultivation facilities.
- Arkansas Department of Health (ADH) runs the patient and caregiver registry and issues registry ID cards.
Licenses are limited in number, so the market is concentrated among a small group of operators. Licensees must track every product in Metrc, the state’s seed-to-sale system, and meet strict security and inventory rules. Adult-use (recreational) marijuana remains illegal in Arkansas.
Arkansas Medical Marijuana Market by the Numbers
- 2025 sales: a record $291.1 million (79,223 pounds), up 5.5% from $275.9 million in 2024 and above the prior record of $283 million set in 2023.
- 2026 year to date: $140.3 million in the first six months, down 2.6% from the same period in 2025, with an average purchase of $75.14.
- Dispensaries: 36 licensed dispensaries in the first half of 2026, down from 37 in 2025. Top sellers include Natural Relief in Sherwood, Suite 443 in Hot Springs and CROP in Jonesboro.
- Patients: 119,074 active patient cards in July 2026, up 7.7% from 110,539 a year earlier.
- Taxes: patient purchases carry the 6.5% state sales tax plus a 4% privilege tax, and cultivators pay a separate privilege tax. Collections totaled $16.8 million in the first half of 2026.
2025-2026 Court Rulings That Shape the Arkansas Market
Two rulings changed the legal footing for Arkansas operators. In December 2025, the Arkansas Supreme Court ruled that the legislature may amend voter-approved constitutional amendments. That decision reversed a 2023 circuit court ruling that had voided dozens of legislative changes to Amendment 98, so lawmakers keep the power to adjust the medical marijuana program by statute.
On hemp, the U.S. Court of Appeals for the Eighth Circuit in June 2025 reversed the injunction that had blocked Act 629 of 2023. The panel held that the law is not preempted by the 2018 Farm Bill, clearing the state to enforce its ban on psychoactive hemp products such as delta-8 THC and its annual license requirement for hemp product sellers and manufacturers. The federal hemp redefinition enacted in November 2025 tightens the rules further nationwide: it moves to a total-THC standard that counts THCA and excludes synthesized cannabinoids, with most provisions scheduled to take effect December 11, 2026. Herring Bank offers hemp banking and CBD banking for compliant operators.
Federal Changes That Affect Arkansas Cannabis Businesses
Effective April 28, 2026, the Justice Department and DEA moved FDA-approved marijuana products and marijuana subject to a qualifying state medical license from Schedule I to Schedule III. Every Arkansas dispensary and cultivator holds a state medical license, so the whole Arkansas market falls within the order. It opens a DEA registration pathway for state medical licensees, and Section 280E of the tax code, which applies only to Schedule I and II substances, is expected to stop applying to licensed medical activity going forward. Adult-use marijuana stays in Schedule I, and a broader rescheduling decision is still pending at DEA.
Federal banking law has not changed. The SAFE Banking Act of 2026 (S. 4942) was introduced in June 2026 and remains in committee. Arkansas cannabis businesses still need a bank that follows FinCEN’s guidance for marijuana-related businesses, with enhanced due diligence, ongoing monitoring and Suspicious Activity Report (SAR) filing.
