2026 Hemp Banking in Texas: Laws, Licensing and Market Status
Texas has a large consumable hemp market, and few states changed their hemp rules as much between 2025 and 2026. For Texas hemp growers, manufacturers and retailers, the rules now come from the Legislature, the governor, state agencies, the courts and Congress all at once. As a Texas-based bank, Herring Bank follows these changes closely.
Who Regulates Hemp in Texas
- Cultivation: The Texas Department of Agriculture (TDA) licenses hemp growers under a USDA-approved state plan (USDA).
- Consumable hemp products: The Texas Department of State Health Services (DSHS) Consumable Hemp Program licenses manufacturers and registers retailers.
- Alcohol-licensed retailers: The Texas Alcoholic Beverage Commission (TABC) enforces hemp sales rules for businesses that hold TABC licenses or permits.
How Texas Hemp Rules Changed in 2025 and 2026
- June 2025: Gov. Greg Abbott vetoed Senate Bill 3, which would have banned most consumable THC products (Texas Tribune).
- September 10, 2025: Executive Order GA-56 directed DSHS and TABC to bar sales to minors and require ID checks, with retailers risking their licenses for violations.
- Fall 2025: TABC adopted emergency rules prohibiting its licensees from selling consumable hemp to anyone under 21 (TABC), and DSHS emergency rules effective October 2, 2025 require a valid government-issued ID showing the buyer is at least 21.
- March 31, 2026: New DSHS Consumable Hemp Program rules took effect. They count THCA toward THC limits and set annual fees of $10,000 per location for a manufacturer license and $5,000 per location for retail registration (DSHS).
- Delta-8: The Texas Supreme Court, in DSHS v. Sky Marketing, confirmed that delta-8 THC beyond naturally occurring trace amounts is a controlled substance, and the state’s delta-8 schedule took effect July 31, 2026.
- Litigation: A Travis County court temporarily blocked parts of the 2026 DSHS rules on May 1, 2026, but the Fifteenth Court of Appeals denied the industry’s emergency motion in June 2026, and enforcement of the smokable hemp rules remains unclear (HPPR/Texas Standard).
Federal Hemp Changes for Texas Businesses
The November 2025 federal funding law (P.L. 119-37) redefines hemp using total THC, including THCA, excludes synthesized cannabinoids and limits finished hemp-derived cannabinoid products to 0.4 milligrams of total THC per container. A September 2026 law (P.L. 119-103) moved most provisions to December 11, 2026, and the synthetic-cannabinoid exclusion begins November 12, 2026 (Marijuana Moment). Smokable hemp and THCA flower products face both state restrictions and the coming federal total-THC standard. The Texas Legislature’s next regular session begins in January 2027.
Hemp Banking Compliance Checklist for Texas Businesses
- A TDA hemp license for cultivation
- A DSHS manufacturer license or retail registration for each location
- Age-21 ID checks at every sale, plus TABC compliance if you hold an alcohol license or permit
- Certificates of analysis that count THCA, and no delta-8 products
- An inventory review against the federal 0.4 mg-per-container limit before December 11, 2026
Congress is also weighing banking protections for hemp. The SAFE Banking Act of 2026 would extend its federal safe harbor to hemp-related legitimate businesses and their service providers and require federal banking regulators to update their hemp banking guidance within 90 days (bill text). The bill remains in committee.
What This Means for Hemp and CBD Banking in Texas
Texas hemp businesses now need DSHS licenses or registrations, age-21 controls, total-THC testing and a plan for the federal change, and banks will review all of it during onboarding and ongoing due diligence. Herring Bank works with Texas hemp growers, processors, manufacturers, wholesalers, retailers and testing labs to open compliant business checking and savings accounts, document licenses, registrations and certificates of analysis for BSA/AML review, manage cash with pickup and delivery through our preferred armored courier, and run payroll, ACH, wires and electronic tax payments.
